to Regulate Ammonium Nitrate.....WASHINGTON,
D.C. - President George W. Bush signed a bill
that regulates the sale of ammonium nitrate. The
new rules were part of the $555 billion
appropriations bill, which allows the Department
of Homeland Security to require that anyone who
produces, stores, sells or distributes ammonium
nitrate to register their facility and maintain

12/04/07 MSHA Issues Ruling on Storage of Div
1.4 Detonators......Washington DC – The
Federal Mine Safety and Health Review
Commission, the board that reviews MSHA citation
appeals, released on November 30, 2007 a ruling
on the storage of Division 1.4 Detonators in
Type 4 magazines, saying, “…there is no
provision in MSHA’s regulations that supports
Austin Powder’s position that using a Type 4
storage facility to house Class 1.4 non-mass
detonating detonators is permissible.” Saying
that the regulation is clear on its face, the
Commission made this decision despite their
review of the regulatory history and despite the
fact that MSHA had not enforced that provision
in the past. As a result of the ruling, all
detonators on mine property should be stored in
Type 1 or 2 magazines.

changes stemming from the Safe Explosives Act,

11/26/07 FMCSA has Published a Final Rule on the
Policy on Calculating Crash Rates and Driver,
Vehicle, and Hazardous Materials Out-of-Service
Rates - FMCSA has Published a Final Rule on
the Policy on Calculating Crash Rates and
Driver, Vehicle, and Hazardous Materials
Out-of-Service Rates and the Top 30 percent of
the National average. This rule is merely a
restatement of the original rule that was
published in 2005. It does nothing to fix the
flawed system for HM Permits.

11/20/07 DHS - Appendix A
Published in Federal Register - On November
20, 2007 the Department of Homeland Security
published the final Appendix A in the Federal
Register. With the publication of a final
Appendix A, all provisions of 6 CFR Part 27,
including §27.210(a)(1)(i), are operative and in
effect. The deadline in the Chemical Facilities
Anti-Terrorism Standard (CFATS) interim final
rule for submission of "Top Screens" required by
6 CFR §27.210(a)(1)(i) will be 60 calendar days
from the date of publication of Appendix A in
the Federal Register.

11/20/07 The Supplemental Mine
Improvement and New Emergency Response Act of
2007 (The S-Miner Act)
– The Congressional Budget Office (CBO)
recently released the Billion Dollar estimate of
the S-MINER Act's cost to the mining industry.
The bill is pending a floor vote in the House of
Representatives, expected to take place after
Thanksgiving. The CBO stressed that it could not
calculate the costs of many provisions, but did
estimate the cost of a few of the bill's
potential mandates: (i) conveyor belts -- more
than $600,000,000.; (ii) communications systems
-- $200,000,000; (III) monitoring systems --more
than $60,000,000; (iv) dust monitors -- more
than $100,000,000; and (vi) monitoring mine
"seals" -- more than $120,000,000. The bill
appears profitable, however, for the federal
government, which CBO estimates would increase
revenue by $157,000,000 by 2017, based on the
bill's increased fines against industry. CBO did
not calculate the massive potential costs of the
new or reduced dust and chemical exposure limits
mandated by the legislation (NIOSH recommended
limits that NIOSH admits do not consider costs
or feasibility).

Ammonium Nitrate Bill Passes House

DC- The House voted Tuesday to require the
registration of sales and purchases of ammonium
nitrate fertilizer. The bill, passed by voice
vote, orders producers, sellers and some

The IME Board of Governors recently approved the
Institute's latest standard; SLP-28
Recommendations for Accountability and Security
of Bulk Explosives and Bulk Security Sensitive
Materials. Despite the fact that bulk
commercial explosive materials have never been
used by terrorists, increasing demands for
security of bulk materials necessitated the
development of SLP-28. IME developed SLP-28 with
input from the International Society of
Explosives Engineers and the Bureau of Tobacco,

Announces Resignation -
Washington, D.C.
Attorney General Alberto Gonzales announced his
resignation, saying that he would complete his
work by September 17th. In his brief
announcement, he thanked President Bush and
Justice Department employees. He said he
had informed the President of his decision to
resign yesterday. No replacement has yet
been named, although Homeland Security Chief
Michael Chertoff's name has been mentioned as a
possible successor.

Bulk Explosives Recommendations Finalized -
WASHINGTON,
D.C.
Recommendations for
Accountability and Security of Bulk Explosives
and Bulk Security Sensitive Materials,
developed by IME’s Bulk Subcommittee of the T&D
Committee, with the assistance of ISEE’s Bulk
Explosives Committee, were recently finalized
and approved by the IME Board of Governors.
Beginning in 2004, ISEE’s Bulk Explosives
Committee, chaired by Jon Stiehr and Tom Watts,
developed the ISEE Bulk Explosives
Presentation and database at the request of
ATF. That Program has been presented to ATF
senior staff and field inspectors as well as to
ISEE chapters and regional conferences on
numerous occasions. ISEE’s original committee
work and data-base were turned over to IME last
year for use in developing the Recommendations.
The document has two
objectives. The first is to provide guidance to
anyone who is involved in maintenance or
regulation of inventory of bulk explosive
materials. The second is to inform the bulk
explosive materials user of the variables and
conditions that affect the accuracy of their
bulk materials inventories in so far as they are
measured for volume and weight. With this
knowledge, personnel can anticipate and identify
fluctuations in their bulk materials
inventories.
The Recommendations offer guidance for
procedural accountability and security of
operations using bulk Division 1.5 and 5.1
materials including ANFO, ammonium nitrate (AN)
prills, emulsions, watergels, AN solutions, and
other materials used in the manufacture of bulk
explosive materials.
Bulk Division 1.5 and 5.1
materials used for commercial blasting are
distributed in a complex network involving many
different modes and methods of handling.
Because of this vast array of circumstances, it
is impractical to recommend a single method for
maintaining accountability of bulk materials.
Instead, the document describes appropriate
methods and associated practices.

ISEE Regulatory Alert - DHS Chemical Facility
Security Standards -
In October of last year President
Bush signed the Chemical Facility Anti-Terrorism
Standards. In April of this year, the Interim
Final Rule for the Standards was published. That
Rule went into effect on June 8, 2007 except for
Appendix A (list of chemicals of concern), which
is proposed only and has not yet been finalized.
In the meantime the information parts of the
rule are enforceable. Final Appendix A is
due out in July. It is important to read
the Final Rule, as you may need to register now.

FMCSA to Conduct Commercial Vehicle Road Checks
this week for OOS Violations -
During the
week of June 4 The Federal Motor Carrie Safety
Administration (FMCSA) along with the Commercial
Vehicle Safety Alliance (CVSA) and the
governments of Canada and Mexico will conduct
the 2007 International Road Check. This event
is held annually. The CVSA is the group
represented by each state along with the support
of the FMCSA that has the responsibility to
determine what violations are deemed critical or
acute and what constitutes an Out of Service
rather it be the driver, vehicle, or hazardous
materials. The highest concentration of
inspections will occur starting at 12:01am June
5 thru 12:00 midnight June 7. This means that
several inspectors will be in travel status on
June 4 and June 8.

security regulations for high risk chemical

Congress, private industry, and the public to
develop consistent guidelines using a risk-based
approach. The new rule gives the department
authority to seek compliance through the
imposition of civil penalties, of up to $25,000
per day, and the ability to shut non-compliant
facilities down.

issued Ruling 2007-1, applicable to Maintaining
Required Explosives Records in Computerized
Form. The ruling addresses the methods used for
computerized inventory record keeping stating
that regulations allow for alternate methods for
such records. However, good cause must be shown
for using such methods and they must be
consistent with the purpose of the regulations.

disposition, magazine summary records, and the

Subpart G, must satisfy the standard of
permanency and are substantially equivalent to
paper records if they meet the following
criteria: 1. All data entered into the computer
system must be recorded into the database and
cannot be capable of being edited or modified at
a later date. The software system must retain
any correction of errors as an entirely new
entry, without deleting or modifying the
original entry. The system may allow for entries
in a notes column to explain any correction. 2.
The system must have a reliable daily memory
backup capability to protect the data from
accidental deletion or other system failure. For
